Paper Title: Law and Politics in Legal Realisms
Abstract: This paper analyses the American and the Scandinavian legal realisms position concerning the question how legal and political phenomena interact with each other. Here the legal realist theories will be placed under a common roof, i.e. the mode of inquiry considering the relations between law and politics in accordance to the answers they give to the three main issues: the static aspect (i.e. how the concept of law relates to politics), the dynamic aspect (how the legal systems interact with the political one) and the epistemological aspect (which uses does legal discipline make of the political material). The results of the inquiry will reveal a model, encompassing the American and Scandinavian legal realisms, which is here defined as 'intersecting' as within it, that law and politics are two overlapping phenomena.
